Abstract:
The United Kingdom’s constitutional system presents a paradox. While Parliament retains theoretical omnipotence, the increasing influence of judicial review and the impact of international treaties and intricate domestic laws, such as the Human Rights Act (HRA), establish a practical framework that substantially restrains this power. Consequently, there exists a tension between the democratic legitimacy of the legislature and the protective function of the judiciary, which is a central aspect of the contemporary debate on constitutional reform in the United Kingdom.
