Abstract: The article examines the essence of the particularly serious crime case under art. 93, para. 8 of Criminal Code. The conclusion is that this qualification should be established in independent qualified compositions of crime, as an alternative, and not cumulatively, to the qualification “particularly large amounts” of the damage caused.
