Abstract
The actuality of the topic of migration in the Republic of Bulgaria and Europe apears from the fact that as a result of the mass departure of groups of people from Middle East and North Africa and their unregulated entry into European countries, the migration processes acquired a wide public response and occupied the main place among the priority tasks of national and international politics. The significance and scale of the problem requires the institutions in each affected country to work intensively in the direction of limiting and regulating the new manifestation of modern migration and presents them with the serious challenge of taking adequate and effective measures to control it. Due to its geographical location, the Republic of Bulgaria found itself in the zone of migration pressure, which the external borders of the European Union have been subjected to for several years. As it is part of the East-Mediterranean route of illegal migration, our country is a transit point for migrants coming from Turkey to countries such as France, Germany, and Great Britain. As the external border of Europe, Bulgaria should fulfill its commitments, observe their correct and accurate implementation, make efforts for enhanced border protection and impose sanctions for violations of the border regime. In this regard, the present research aims to answer several questions regarding where the regulation of migration movements is located in the Bulgarian legislation, whether there is a need for legislative changes with a view to improving the legal regulation of migration processes and what they should be.

Актуалността на темата за миграцията в Република България и Европа произтича от факта, че в следствие на масовото напускане на групи от хора от Близкия Изток и Северна Африка и нерегламентираното им навлизане в европейските държави, миграционните процеси придобиха широк обществен отзвук и заеха основно място сред приоритетните задачи на националната и международната политика. Значимостта и мащабът на проблема налага институциите във всяка засегната държава да работят интензивно в посока на ограничаване и регулиране на новото проявление на съвременната миграция и ги поставя пред сериозното предизвикателство за предприемане на адекватни и ефективни мерки за неговото овладяване. Поради географското си разположение Република България се оказа в зоната на миграционния натиск, на който от няколко години са подложени външните граници на Европейския съюз. Тъй като е част от източно-средиземноморския маршрут на незаконната миграция, страната ни е транзитен пункт на идващите от Турция мигранти към държави като Франция, Германия, Великобритания. Като външна граница на Европа България следва да изпълнява поетите ангажименти, да съблюдава за правилното им и точно изпълнение, да полага усилия за засилена охрана на границите и да налага санкции за нарушенията на граничния режим.
