THE RIGHT TO NON-DISCRIMINATION IN THE CONTEXT

OF JOHN RAWLS`S THEORY OF JUSTICE

Abstract: The article argues that the Right to Non-discrimination is a fundamental right of citizens. Modern law as a basic institution of society has the significant role of designing institutional mechanisms for the protection of Human Rights. The veil of ignorance reasoning in the context of John Rawls’s Theory is used to explain the Right to Non-discrimination as a complex right that compounds all generations of Human Rights.

Three main issues are considered in the article: 1) the Right to Non-discrimination and the universal nature of Human Rights; 2) The importance of the Right to Non-discrimination in affirming the principle of equality before the law, taking into account social justice; 3) The Right to Non-discrimination in the Case Law of the European Court of Human Rights – European institutional context of protection against discrimination. The Protocol No. 12 to the European Convention of Human Rights and Fundamental Freedoms is argued as an innovative approach to ensuring equal access to rights of every citizen
